Condition
Applicability
These terms and conditions of purchase are applicable in cases where United States or other applicable law does not provide for terms that are in conflict with the same. For private consumers, the Consumer Sales Act and the Distance Contracts Act apply, and for companies - the Sale of Goods Act. The Sale of Goods Act, unlike the Consumer Sales Act, is dispositive, which means that companies can enter into agreements other than what the law prescribes.
Order
All orders placed with DesignCases are binding.
If the customer is under 18 years of age, the guardian's permission must be obtained from the customer before the purchase is carried out. Orders made in another person's name without their consent, or in any other way that causes us to suffer financial or other damage, will be reported to the police.
Delivery
Our ambition is to deliver our goods within 5-9 working days.
Delays on the part of FedEx, UPS, Dhl, EMS/Posten may occur and unfortunately we have no control over these.
We reserve the right to change an order regarding content to an equivalent/better product without affecting the price the customer has been confirmed, or remove non-deliverable goods from the order, and then of course with a price reduction for the same. If the customer subsequently wishes to order another or the aforementioned product, this is to be regarded as a new order. In the event that the buyer considers that delivery is delayed in such a way that he no longer wishes to deliver the order, it is the buyer's responsibility that the said order is cancelled in accordance with these Terms and Conditions of Purchase before execution of the order takes place.
Supplies
All deliveries are made by a carrier chosen by us, according to the delivery methods presented before completion of the order, usually FedEx, UPS, Dhl, EMS/Posten. It is the buyer's responsibility to ensure that the address provided to us at the time of ordering is correct, and that the buyer, after we have executed the order, follows up the delivery with the freight forwarder, and ensures that the delivery is picked up/received at the pick-up point within a reasonable time from dispatch, usually nine (9) days from dispatch. In the event of uncollected/uncollected packages, we reserve the right to charge you USD 30 regardless of the purchase amount, to cover our administrative costs, shipping and return shipping. Payment must be made within fourteen (14) days from the date of invoice.
Examination of goods on receipt
Inspect your product as soon as you receive it and make sure that the product works satisfactorily. If you discover any damage to the box/product, you should ask the Post Office to take back the item immediately. Visible shipping damage must be reported directly to the postal service upon receipt or collection of the goods. Hidden shipping damage must be reported to us within 2 days. It is important that you keep all packaging. Without the original box and packaging, you lose the opportunity to receive compensation for shipping damages.
Change of order
Up to the point where the order has been executed, the customer has the right to change his order at no cost to him other than the price difference of the product, but with reservation for goods ordered by the customer which are not kept in stock. When changing a product on order, the price that is current at the time of the change applies. Please note that orders that have already been delivered from our system cannot be changed for obvious reasons.
Cancellation
Cancellation of orders is possible at no cost to the customer until the time the order is executed. Execution is usually done by creating invoices and shipping documents. Cancellation after the order has been executed is not possible. If we have fulfilled your order, you as a customer are obliged to receive the shipment in all cases. A cancellation is not valid until confirmation has been received from us.
Withdrawal
The recipient has the right to cancel their purchase or change to another size, color or product within 14 days. We require the item to be unused and returned in its original packaging with any original documents. Please contact us via hamiltonshelby@126.com before returning your package. In that case, state your order ID, any invoice number and which product it concerns. Also state if you want to exchange for another product instead, or if the money is to be returned to the customer. Anyone who returns a product must be responsible for return shipping and transport risk. We will email you when the return has been inspected and approved/not approved. We do not collect items that are returned cash on delivery/registered mail or are not fully franked.
When exercising the right of withdrawal, the recipient must pay our shipping fees, which may exceed the shipping amount we paid the recipient when ordering. (Currently $25-$45)

Complaints
According to the Consumer Sales Act, private individuals have a two (2) year right of complaint, regardless of the warranty period that applies to a product. Complaints must be made within a reasonable time from the time the defect was discovered. In the event of a complaint after the expiry of the warranty period, it is the buyer's responsibility to prove that the defect complained of existed already at the time of delivery.
Returns
We reserve the right to replace a defective product with an equivalent product in the event that an identical product is not available at the time of rectification of the returned product.

Information
We reserve the right for typographical errors, errors in information, and errors in specifications, on all items and services in our range. All image information on our pages should be seen as illustrations, and we cannot guarantee that the image reflects the exact appearance/color and nature of the product.
Dispute
In the event of a dispute where the buyer is a private individual, we have a policy of always following the recommendations of the National Board for Consumer Disputes. Disputes between two or more companies are usually settled in court.
Personal data
When you shop with us, you provide personal information such as name, address, e-mail address and telephone number. We need this information to deliver the product to you, but also for warranty matters. We need the e-mail address to confirm orders/deliveries, but will also serve as a username the next time you shop in our Internet shop.
Designcases customer-facing employees have access to the stored data. Otherwise, they are only accessible if you log in with your account details. As a customer, you have the right to receive the information we have registered. If the information is incorrect, incomplete or irrelevant, you can request that it be corrected or removed. In this case, please contact our customer service. We do not disclose personal data to third parties.
All transfer of user information between the site and our business system takes place through secured SSL encryption. Your password is also protected by a powerful hashing algorithm (a form of encryption). Cash flow is secured and no information can be changed or disclosed.
Force majeure
In the event of war, natural disasters, industrial action, government decisions, non-deliveries from subcontractors, costly circumstances, and comparable events beyond our control that could not reasonably have been foreseen, and affect agreements entered into and commitments made by us, which means that we cannot keep said agreements/promises, shall constitute grounds for us to be released from our obligations to fulfill said agreement.
